Terms of Service

These Terms of Service (“Terms”) govern your use of TrackEDU, including TrackEDU Facilities and other TrackEDU products, websites, applications and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

If you are using TrackEDU on behalf of a school, organisation or other entity, you confirm that you have authority to accept these Terms on its behalf.

1. About TrackEDU

TrackEDU provides digital tools for schools, teachers and education staff, including facility booking, scheduling, classroom organisation, calendar integration and related administrative features.

2. Eligibility and accounts

You must provide accurate information when creating or using an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for activity carried out through your account unless caused by a security failure attributable to TrackEDU.

3. School and administrator responsibilities

Schools and authorised administrators are responsible for deciding which staff may access the Services, what permissions they receive and what information is entered into the platform. Schools are also responsible for ensuring that their use of TrackEDU complies with applicable education, employment, privacy and data-protection requirements.

4. Facility bookings and scheduling

TrackEDU Facilities is intended to support booking and scheduling workflows. Schools remain responsible for their own booking policies, approvals, room access rules, staffing arrangements and operational decisions. TrackEDU does not guarantee that a facility is physically available, safe or suitable for a particular activity.

5. Google Calendar integration

Users may optionally connect Google Calendar to TrackEDU Facilities. When connected, TrackEDU may create, update and delete TrackEDU facility-booking events on calendars owned by the connected user in order to keep those events synchronised with TrackEDU.

Users may disconnect Google Calendar at any time. TrackEDU’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Google Workspace API data is not used to develop, improve or train generalised artificial intelligence or machine-learning models.

6. Artificial intelligence features

Some TrackEDU products may include optional AI-assisted features. TrackEDU currently uses the Google Gemini API on a Paid Tier 1 plan (Firebase Payment / Prepay) to provide certain AI-assisted features.

AI-generated content may contain errors, omissions or inappropriate suggestions and should be reviewed by a responsible user before being relied upon. Users remain responsible for professional, educational and operational decisions made using AI-assisted output.

TrackEDU Facilities does not send Google Calendar or other Google Workspace API data to Gemini or to any other AI/ML service. Google Workspace API data is not used to develop, improve or train generalised artificial intelligence or machine-learning models.

TrackEDU’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

7. Acceptable use

You agree not to use the Services to:

break applicable laws or regulations;
gain unauthorised access to accounts, systems or data;
upload malicious code or deliberately interfere with the Services;
impersonate another person or misrepresent your authority;
use the Services to harass, discriminate against or harm others; or
copy, resell or exploit the Services except as expressly permitted by TrackEDU.

8. Trials, subscriptions and payments

TrackEDU may offer free trials or promotional access. Unless otherwise stated in writing, a free trial does not create an obligation to purchase. If a school chooses to continue using a paid service after the trial period, the applicable subscription fees and billing terms will be communicated before payment is required.

Paid subscriptions may be changed, renewed or cancelled according to the terms shown at the time of purchase or in a separate agreement with the school.

9. Intellectual property

TrackEDU and its associated software, branding, interfaces, designs and original content are protected by intellectual-property laws. These Terms give you a limited right to use the Services but do not transfer ownership of TrackEDU intellectual property to you.

Users retain ownership of content they lawfully submit to the Services, subject to the permissions required for TrackEDU to host, process and display that content in order to provide the Services.

10. Privacy and data protection

Our handling of personal information is described in the TrackEDU Privacy Policy. By using the Services, you acknowledge that information will be processed as described in that policy.

11. Third-party services

The Services may connect with third-party products such as Google services. TrackEDU is not responsible for the availability, security or independent terms of third-party services. Your use of those services may also be governed by their own terms and privacy policies.

12. Availability and changes to the Services

We aim to keep TrackEDU available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may be improved, modified, suspended or discontinued where reasonably necessary for security, maintenance, legal compliance or product development.

13. Suspension and termination

We may suspend or terminate access where reasonably necessary because of misuse, security risk, non-payment, legal requirements or a material breach of these Terms. Users and schools may stop using TrackEDU at any time.

14. Disclaimer

To the extent permitted by law, the Services are provided on an “as available” basis. TrackEDU does not warrant that every feature will always be available, that all generated or imported information will be error-free, or that the Services will meet every school’s individual operational requirements.

15. Limitation of liability

To the maximum extent permitted by applicable law, TrackEDU will not be liable for indirect, incidental, special or consequential loss arising from use of the Services, including loss resulting from scheduling errors, missed bookings, third-party outages or user-entered information.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date and, where appropriate, provide notice through the Services or by other reasonable means.
